By opening kruegertravel.com you accept these terms. If any part of them is unacceptable to you, the appropriate response is to stop using the site, which costs nothing since nothing here requires an account or a payment.

The site is operated by Krueger Editions LLC, a Hawaii limited liability company, of 745 Fort Street, Honolulu, HI 96813, United States. In these terms, the words we, us and our mean that company, and the words you and your mean the person reading.

These terms apply to every page on this domain, including the journal pages, the story index, the contact page, and any form on any of them.

What this site is

Krueger Travel is an independent journal about coastal and island travel. It publishes written pieces, photographs made on the same trips, and the practical notes that came out of those trips.

That is the entire service. There is nothing to sign up for, no account to create, no software to download, no subscription, and no premium tier. The reader note list is the only thing you can join, and joining requires an email address and nothing else.

What this site does not do

This part is written plainly because it is the part people most often assume the opposite of.

We do not sell anything. There is no shop, no basket, no checkout, no price on any page, and no mechanism by which money could be taken from you through this site.

We do not book, reserve, hold, or arrange any element of travel. We are not a travel agency, a tour operator, a booking platform, a fare comparison service, or an agent for any such business.

We do not take payments. Because no payment is ever taken, no payment methods are accepted, no payment information is collected, and no billing terms apply. There is nothing to refund, cancel, or charge back, and any page elsewhere claiming to take a payment on our behalf is not us.

We ship nothing and deliver nothing physical. There are no goods, so there are no delivery times, delivery areas, delivery charges, or shipping conditions, and there is no returns process because nothing can be bought and therefore nothing can be returned. If a future version of this site ever offered anything for sale, full payment, refund, cancellation and delivery terms would be published before the first item was listed.

We are not affiliated with any airline, hotel, resort, ferry operator, rental company, tour company, or booking platform, and we do not act on behalf of any of them.

Editorial content and the limits of it

Everything published here is one writer's account of specific days in specific places. It is offered in good faith and with reasonable care, and it is not a professional service, an inspection, a certification, or a guarantee about anything.

Conditions on a coast change. Roads close, access rules change, reservation systems are introduced and withdrawn, and a path that was open in one season may not be in the next. Information that was accurate on the day a piece was published may be wrong by the time you read it, which is why every story carries its publication date and why corrections are printed at the top of the piece rather than folded into the text.

The field notes describe how one traveler approaches unfamiliar water. They are not safety instruction and they do not replace posted signs, local advice, lifeguard direction, official warnings, or a current forecast. Where anything here conflicts with an official source, follow the official source. Decisions you make about where to go and what to do there are yours, taken with your own judgement about your own abilities and the conditions in front of you.

Copyright and how you may use this material

All text, photographs, layout, code, and design on this site are the property of Krueger Editions LLC and are protected by copyright. Nothing here is public domain and nothing here is offered under an open licence.

You may read the site, print pages for your own use, and quote briefly from the writing with a visible credit and a link back to the page quoted. A brief quotation means a sentence or two used for comment or reference, not a paragraph lifted whole and not a reproduction of the practical notes.

You may not republish stories in whole or in substantial part, copy photographs to another site, service, or social account, including with a credit line, use anything from this site to train a machine learning model or to build a dataset, sell or license any of it, present it as your own work, or scrape the site systematically.

Requests to reuse a photograph are welcome and are considered one at a time. Write to [[email protected]](mailto:[email protected]) with where the image would appear, for how long, and in what context.

Copyright complaints

A rights holder or authorised representative who considers that something on this site infringes their copyright should write to Krueger Editions LLC, 745 Fort Street, Honolulu, HI 96813, United States, or to [[email protected]](mailto:[email protected]), marked for the attention of the copyright agent.

Include identification of the work you say is infringed, identification of the material on this site and the page it appears on, your contact details, a statement that you believe in good faith that the use is not authorised, and a statement that the information in your notice is accurate. Valid notices are acted on promptly, and where material is removed the person who supplied it, which on this site is the publisher, is informed.

Acceptable use

Use the site for reading. Do not attempt to gain unauthorised access to any part of it or to the systems it runs on. Do not probe, scan, or test the security of the site or its hosting. Do not introduce malicious code. Do not interfere with anybody else's use of the site.

Do not use automated tools to harvest content in bulk, and do not place unreasonable load on the site. Do not use the contact form to send unsolicited commercial messages, link exchange proposals, guest post pitches, or anything abusive, and do not impersonate anybody when you write in.

Access may be blocked where any of the above happens, and no notice is owed before that happens.

This site does not carry outbound links to other websites. Internal links move between pages of this journal, and the only external requests the site makes are the ones needed to deliver a form you chose to submit.

If a link to another site ever appeared here, it would not imply endorsement of that site or of anything on it, and we would have no control over its content, its privacy practices, or its availability.

Disclaimer of warranties

The site and everything on it is provided as it is and as it is available, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non infringement.

We do not warrant that the site will be uninterrupted, timely, secure, or error free, that any information on it is complete or current, or that any defect will be corrected. Some jurisdictions do not allow the exclusion of certain warranties, and in those places the exclusions above apply only so far as the law permits.

Limitation of liability

To the fullest extent the law allows, Krueger Editions LLC and anybody connected with it will not be liable for any indirect, incidental, special, consequential, or punitive loss, or for any loss of profit, revenue, data, or goodwill, arising out of your use of this site or your reliance on anything published on it.

Where liability cannot lawfully be excluded, total liability for any claim connected with this site is limited to one hundred United States dollars. Since nothing on this site is sold and nothing is paid for, that figure is a ceiling rather than a refund.

Nothing in these terms limits liability for fraud, for fraudulent misrepresentation, or for anything else that cannot be limited under applicable law.

Indemnity

You agree to indemnify Krueger Editions LLC against claims, losses, and reasonable legal costs arising from your breach of these terms or from your misuse of material published here, including any unauthorised republication of text or photographs.

Governing law and where disputes are heard

These terms and any dispute arising out of them or out of the site are governed by the laws of the State of Hawaii, without regard to conflict of law principles.

Any dispute is to be brought exclusively in the state or federal courts located in Honolulu, Hawaii, and both sides consent to the jurisdiction of those courts. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory provisions of the law of your own place of residence.

Changes to these terms

These terms may be revised. When they are, the revision date at the top of this page changes, and continuing to use the site after that date means the revised version applies to you.

Material changes are noted on this page for at least ninety days. If you disagree with a revision, stop using the site.

Severability and entire agreement

If any provision of these terms is found unenforceable, that provision is limited or removed to the minimum extent necessary and the rest stays in force.
